Bankruptcy

We work with our clients in exploring all available options for working through their financial difficulties.  For some, declaring bankruptcy may prove the best option.  Depending on your financial situation, one type of bankruptcy may be preferable over another. 

  • Chapter 7 Bankruptcy
    Under Chapter 7, also called "straight" bankruptcy, a person or business must sell all non-exempt assets and use the proceeds to repay debts.  Any debts not covered by the sale are generally discharged, with some exceptions.  In many cases, businesses declaring Chapter 7 bankruptcy cease to operate.
  • Chapter 11 Bankruptcy
    Businesses typically declare Chapter 11 bankruptcy when they need help reorganizing their business structure.  This allows them to remain in operation while they pay their debts in a timely manner.  Chapter 11 bankruptcy requires the business and the creditors to implement and comply with a confirmed repayment plan.
  • Chapter 13 Bankruptcy
    Chapter 13 bankruptcies are suitable for individuals who are still earning income but need some assistance repaying their debts.  Under Chapter 13, the individual adopts a repayment plan whereby the loans are repaid over three to five years. 

Bill Consolidation Loans

Consumer finance companies advertise "bill consolidation loans" as a solution to those having difficulty paying their bills.  They purport to combine all of your debts into one loan with one monthly payment, but these companies know that anyone who is looking for a bill consolidation loan is already in financial trouble.  This means you will be charged higher interest rates, which can actually cause your debt to increase.  If you are considering purchasing a bill consolidation loan, it is important to consult with an experienced attorney who can help you find a better way to consolidate, and ultimately eliminate, your debts.
